We built our insurance defense practice around the claim types that create the most exposure for carriers and self-insured policyholders. Our attorneys handle:
Each matter is handled by our attorneys who have carried similar claims to trial in Louisiana courts, not just to a mediation table. Our firm’s standing in the legal community is reflected in its AV Preeminent rating from Martindale-Hubbell and multiple Super Lawyers selections.
Louisiana law imposes a rigorous timeline on how insurers handle a claim, and that clock usually starts well before a lawsuit is ever filed. Under La. R.S. 22:1892, an insurer must generally pay a claim within 30 days of receiving a satisfactory proof of loss. Claims tied to a catastrophic event, such as a hurricane, run on a different clock. The insurer gets 60 days, and that period can extend to 90 days when the governor or president has declared an emergency or disaster.
Should a court determine that a delay was arbitrary, capricious, or without probable cause, it may assess significant penalties beyond the underlying claim value.
This exposure exists independent of the primary award, making a defense strategy centered on the procedural timeline as vital as the merits of the case. Retaining experienced trial counsel early helps build a documented, defensible record that reduces the risk of these penalties.
Historically, Louisiana allowed claimants to name insurers directly in lawsuits, often signaling to juries the presence of deep-pocket coverage. Recent legislative changes have changed that.
Under the current framework of La. R.S. 22:1269, plaintiffs are generally prohibited from direct actions against carriers, and the insurer’s identity remains shielded from the jury and the case caption. These protections are subject to limited exceptions, including the insolvency of the insured, failures in service, or specific family and uninsured-motorist claims
The reservation of rights exception remains a primary concern for carriers, as missing notice deadlines can cost an insurer its statutory protection. An insurer denying coverage or reserving rights must:
Our New Iberia insurance defense lawyers’ approach integrates these critical notice deadlines into the defense file from the outset.

For claims arising on or after July 1, 2024, most personal injury and property damage claims carry a two-year prescriptive period running from the date of the injury or damage, following the state’s 2024 shift away from its former one-year deadline. Claims that arose before that date still follow the old one-year rule.
Louisiana allows a penalty on top of the underlying claim when a court finds an insurer’s delay in paying or adjusting a claim was arbitrary, capricious, or without probable cause under La. R.S. 22:1892. Our insurance defense attorneys in New Iberia build the claims handling record early, so the file already shows a reasonable, documented process if a bad faith allegation is added later.
Caffery, Oubre, Campbell & Garrison, L.L.P. has represented insurers and policyholders in Acadiana for decades, with attorneys who know the 16th Judicial District Court from the inside. Our attorneys are also admitted before the U.S. Court of Appeals for the Fifth Circuit and the U.S. Supreme Court, so a case that gets removed to federal court does not require a handoff to different counsel.
